TERMS OF SERVICE:

GENERAL
You are held accountable to the following terms when purchasing or acquiring a custom print from AFWild Photography. Failure to comply with terms laid out by this document and by the Photographer or failing to adhere to Copyright Infringement laws and fair use may result in DMCA or Legal Action.

TURN AROUND TIME

Delivery of finished pieces may take up to two months depending on what is happening in the photographer’s personal life, how big the queue/back log is and whether it is a custom order. Standard or small orders on occasion are completed earlier then estimated turnaround time. The client will be informed of any unexpected delays and will try their best to keep an active line of communication in the event of delays. You as the Client acknowledge that the photographer has additional commitments and personal responsibilities beyond their work and occasionally, they may need to address or prioritise other matters in their life.

PAYMENTS POLICY
Payments are in AUD. ‘Exposure’ or 'promotion' will not be accepted as a form of payment. The Photographer does not offer friend, association or connection discounts. Regardless if you may have an association or relation with the photographer, it does not mean you are entitled to cheaper, discounted or free pieces.

REFUND & RETURNS POLICY
Refunds will only be accepted and issued upon client request BEFORE items are shipped. Once items have been shipped refunds can no longer be issued and cannot be offered once items are received by client. Refunds cannot be issued on damaged items due to online scams. If item(s) are received damaged, please contact the photographer to organise the return of the damaged item and discuss its replacement.

COMMERCIAL USE RIGHTS LICENSING
If the Client is requesting Commercial Rights or Licensing on a Picture, Print, Sticker, etc. Depending on the inquiry, a contract and an agreed upon terms of compensation or heightened fee will be discussed. The fee cost or compensation will vary depending on the intended use and distribution of the pieces.

COPYRIGHT AND FAIR USE
The Photographer Has the Right To -
The Photographer retains full rights to the piece. The Photographer has the right to use the pieces for self-promotion, examples, personal portfolio, and to publicly display or publicly post where deemed fit. Unless a ‘Commercial Use Rights Licensing’ for a particular piece and contract was discussed.

You The Client Have the Right To -
The Client has the right to use the pieces for personal means such us;
Display, Gifts, Scrapbooking, Collages, Letters, etc.

You The Client Can Not -
Take credit for the creation of the piece and falsely claiming authorship of the photo, including submitting the piece to an art gallery or photography contest. The Client cannot use the pieces in depictions of spreading/promoting hate speech. Unless a ‘Commercial Use Rights Licensing’ fee or contract has been discussed and priced, the client cannot buy products with the intent to resell, gain a profit or distribute. This can include, selling at farmers markets, festivals, online marketplaces, small businesses, ads, etc. You are not to use any pieces made produced by AFWild Photography for any AI related purposes. This can include, altering the piece with AI, feeding a piece into AI for training purposes or claiming a piece by the Photographer was created by an AI generator.
